This policy (“Shipping Policy”) governs the shipment and delivery of the bike, accessories and any other products offered for sale by [Calamus UK Limited] (hereinafter referred to as “Calamus”). The Shipping Policy is effective upon successful placement of your purchase order on our Platform. The terms and conditions that constitute our Shipping Policy are given below.
Any capitalized terms used in the Shipping Policy not defined herein shall have the meaning provided to it under the Terms of Service.
“We” capitalized or otherwise, refers to Calamus and related phrases “us” and “our” should be understood accordingly.
“You” capitalised or otherwise, means the customer who has placed a purchase order on our website https://calamusbikes.com/ or such website or any other mobile application powered by Calamus to provide the bike/product(s). “Your” capitalised or otherwise, has a corresponding meaning.
1. Order Placement
1.2 Please note we accept the following forms of payment for any purchase made on our Platform:
1. Debit card/Credit card (Visa, MasterCard, American Express, [.])
2. Net Banking
1.3 Please note that the bike is delivered in a semi-assembled form and you will have to assemble the parts in the manner detailed on our Platform.
2. Shipping Cost
All orders are subject to product(s) availability. We reserve the right to cancel any order at any time before the product(s) is delivered. Shipping is free for all orders placed on our website and is included in the total purchase price which is calculated and shown in the order summary at the time of checkout process. The prices for each product and/or service may vary based on the delivery location address mentioned by you.
3. Delivery Location
3.1 We deliver our bikes/products UK only.
3.2 Our products are shipped from India to the address provided by you on the Platform while placing your order. Please make sure that the bike you select is compatible with your local regulations and law applicable there.
4. Delivery Time
4.1 Once your order has been placed, and the order has left our warehouse, we will send you a shipping notification on your e-mail address registered with your Calamus Account or with the e-mail address used by you to place your order on our Platform. The notification will provide an estimated delivery time. Standard international delivery can take up to thirty to ninety (30-90) business days. Business days means any day of the week (excluding Saturdays, Sundays and public holidays in India and/or the country of delivery location). We do not ship on Sundays. For orders placed on our Platform, the estimated shipping date is by 31st December2021. Please note that the shipping timeframe provided is a good faith estimate and not guaranteed. However, if shipping is delayed beyond three (3) months of the estimated delivery date provided to you, you will be entitled to receive a full refund of your order without incurring any cancellation fee.
4.2 Please note that delivery times are estimates and not guaranteed and commence from the date of shipping, rather than the date of placement of order. Delivery times are to be used as a guide only and we are not bound to deliver the product(s) in the estimated delivery time. You will receive e-mail updates and notifications containing the details of your order.
4.3. If you have a Calamus Account you can track your shipment by logging into your Calamus Account. In the event that you do not have a Calamus Account, in the confirmation e-mail we send you once you have placed an order, we will send you a link to enable you to create a Calamus Account. Please note that you will not be able to track the progress of your order if you do not have a Calamus Account.
4.4 We work with international shipping partners to get your order to you as soon as possible; however, delivery times vary depending on where you are ordering from. Any timeframe provided by Calamus for when the product(s) may ship or be delivered is a good faith estimate. While we do our best to meet that timeframe, it is not a guarantee. Some countries have local procedures regarding the import of goods, which are outside of our control. Calamus cannot be held liable for late or early deliveries.
4.5 Date of delivery may vary due to carrier shipping practices, delivery location, method of delivery, the items ordered as well as any natural calamities, epidemics or any event out of our control. Product(s) may also be delivered in separate shipments. If an item becomes unavailable after your order has been confirmed and paid for, we will contact you to make arrangements for later delivery or refund the price you paid for the item without any interest. If your order includes items that are temporarily unavailable, we will send the available items purchased out first and will follow with the outstanding items once they are available again, unless the products do not function without one another. No additional shipping fees will be applicable.
4.6 Please make sure that someone is available to sign for the delivery of your shipment. Your shipment may not be delivered in the event that there is no one available at the delivery location. In the event that the order has been signed and collected by an unauthorized person at the delivery location, please immediately contact our customer care team at [.]. While Calamus shall provide all reasonable assistance to locate the delivery, Calamus shall not be responsible or liable for the same.
5. Customs, Duties and Taxes
5.1 The prices of the bike/products are inclusive of all taxes, shipping costs, custom duties, import taxes (if applicable) etc. We reserve the right to change the price of any of our bikes/products without any prior notice. You are obligated to confirm the price mentioned at the time of check out before placing any order. Please note that in the event any change in the applicable law or laws of the country where the products are being delivered results in an increase in the price of the products including but not limited to an increase in custom duties, export duties etc., subject to Section 5.3, then you will be liable to bear such extra costs as communicated to you by us. For more information about your country’s custom policies, please contact your local customs office.
5.2 We shall attempt to accurately show all country specific delivery prices, however, owing to the complexities involved with shipping internationally we reserve the right to revise shipping costs. If this occurs we will contact you prior to shipping.
5.3 In the event of any change in the prices as mentioned in Section 5.1 and 5.2, your order will not be shipped/delivered if you fail to pay the increased amount in the price to us. In the event that you do not wish to proceed with your order due to these increased prices you will have the right to cancel the order in accordance with our Return Policy.
6. Undelivered Order
6.1 Our delivery partners will attempt to deliver the package twice before it is returned to our warehouse. Deliveries can fail due to multiple reasons such as wrong address, delivery refused by the recipient, nobody is available at the delivery location etc. If the order is returned due to incorrect address, the correct address will be taken from you post which the shipment will be re-sent to you. In such a scenario if there is any additional delivery price which is levied, you shall be liable for the same.
6.2 All undeliverable packages will be returned to us and a full refund will be processed (if the payment is already made). Our courier partners in most circumstances will not be able to retrieve and deliver an undeliverable package even if it is at a local courier station. Please re-order the item if you still wish to purchase the item.
6.3 If your package is misplaced or does not arrive, please immediately contact our customer care team at [.].
7.1 Calamus uses the following carriers to make sure your items arrive on time:

8.1 All risk of loss or damage to the products shall pass to you, or a person designated by you, upon taking physical possession of the product(s).

9.1 The Shipping Policy is designed in the best interest of our valued customers. The Shipping Policy may be changed in time without prior intimation and it is Calamus’s sole prerogative to change it.
9.2 We will try our best to deliver the bike/accessories and any other product(s) ordered by you on our website on time. However, delays due to force majeure events are out of our control and may affect the delivery schedule. Issues arising at the courier’s end are also out of our control. However, we will do everything in our capacity to ensure the delivery of the bike/product(s) at your doorsteps. Calamus will not be liable to you in any manner whatsoever for any delays in shipping and delivery of the bike/accessories and any other product(s).
